Mechanic's lien deadlines in Delaware: the 2026 guide for subcontractors

If you furnish labor or materials on a Delaware project and you don't get paid, a mechanic's lien is how you force the issue. But the right to file expires fast. Here are the deadlines that matter, in plain language.

  1. Record Your Mechanics Lien

    Record your mechanics lien with the county recorder, generally within about 120 days after the last day you furnished labor or materials to the project.

  2. Deadline to Enforce the Lien (Lawsuit)

    File a lawsuit to enforce (foreclose) your lien, generally within about 12 months after the lien is recorded, or the lien can expire.
